1. General
    • This Avertum Tech-Air maintenance and repair service (the “Service”) is offered by REV'IT! eStore Europe B.V. (“REV’IT!”) to customers in the European Union. This Service shall only be available for the REV’IT! and Alpinestars Tech-Air collaboration airbag (the “Airbag Avertum Tech-Air®”) at a REV’IT! service centre.

  2. Service
    • REV’IT! offers one of three Services:
      1) Inspection Service; or
      2) Inflator Recharge Service; or
      3) Full Recharge Service.  
    • In order to obtain Service to the Airbag Avertum Tech-Air®, the customer is required to fill out the Avertum Tech-Air® Airbag Service Request Form on revitsport.com. All requested information on the Avertum Tech-Air® Airbag Service Request Form must be provided by the customer and the customer warrants the correctness and completeness of this information.
    • The customer is solely responsible for shipping the Airbag Avertum Tech-Air® to a REV’IT! service centre at its own risk and expense. Shipment must take place in accordance with REV’IT!’s shipping instructions as sent by REV’IT! to the customer via email. The email with instructions will be sent to the customer after the Avertum Tech-Air® Airbag Service Request Form has been filled out and sent by the customer.
    • Upon receipt of the Airbag Avertum Tech-Air®, REV’IT! will perform an inspection of the Airbag Avertum Tech-Air®. Thereafter, REV’IT! will contact the customer through the phone number and/or e-mail, as provided by the customer on the Avertum Tech-Air® Airbag Service Request Form, to offer and advise the customer on the required maintenance to the Airbag Avertum Tech-Air®.
    • REV’IT! will inform the customer of the cost of maintenance and an approximate timeframe REV’IT! requires for performing such Service.
    • Upon acceptance of the offer by the customer, whether oral or in writing, REV’IT! will send the customer a payment link through which payment for the Service shall be made by the customer. REV’IT! will start Service of the Airbag Avertum Tech-Air® in accordance with the agreed Service between REV’IT! and the customer upon receipt of payment.
    • The prices for the Services shall be as follows:
      1) Inspection Service: € 104,95
      2) Inflator Recharge Service:     € 169,95         
      3) Full Recharge Service:          € 314,95
    • In the event the Airbag Avertum Tech-Air® cannot be Serviced, REV’IT! will inform the customer. The Airbag Avertum Tech-Air® will be shipped back to the address provided by the customer on the Avertum Tech-Air® Airbag Service Request Form at the customer’s expense and risk.
    • In the event the customer does not wish to obtain Service to the Airbag Avertum Tech-Air® after the airbag is inspected, REV’IT! will charge the customer an inspection fee depending on the type of Service. Thereto, REV’IT! will send the customer a payment link via email. Upon receipt of payment, the Airbag Avertum Tech-Air® will be shipped back to the address provided by the customer on the Avertum Tech-Air® Airbag Service Request Form at the customer’s expense and risk.
    • In the event the Airbag Avertum Tech-Air® cannot be delivered to the address provided by the customer in the Avertum Tech-Air® Airbag Service Request Form, the Airbag Avertum Tech-Air® will be at the customer’s disposal at the REV’IT! service centre for 30 days. The customer may pick up the Airbag Avertum Tech-Air® during this time, provided payment has been made in full. In the event the Airbag Avertum Tech-Air® is not picked up after thirty (30) days from the notification that the Airbag Avertum Tech-Air® is at the Customer’s disposal at the REV’IT! service center, REV’IT! shall have the right to sell, destroy or otherwise dispose of the Airbag Avertum Tech-Air® directly or indirectly and at its sole discretion.

 

  • If and when provided, timeframes, including shipping dates, delivery dates and duration of Service, shall be approximate only and shall never be considered final and binding deadlines, unless otherwise agreed in writing.

  1. Price and Payment
    • REV’IT! may increase the price of the services in its sole discretion. Already submitted service requests will not be affected by such increase.

    • In the event the customer does not pay within fourteen (14) days of REV’IT! contacting the customer to discuss the Service, REV’IT! will ship the Airbag Avertum Tech-Air® back to the address provided by the customer on the Avertum Tech-Air® Airbag Service Request Form at the customer’s expense and risk. It is the customer’s sole responsibility to provide accurate contact information on the Avertum Tech-Air® Airbag Service Request Form and to ensure that the payment link can be received by the customer.

    • If a fixed price has been agreed for the Service and during the performance of the Service, REV’IT! determines that it is necessary to amend or supplement the agreement for proper repair of the Airbag Avertum Tech-Air®, the parties will timely and in mutual consultation adjust the agreement. If the nature, scope or content of the agreement is changed in qualitative and/or quantitative terms, this may have consequences for what was originally agreed by and between the parties. As a result, the originally agreed price may be increased or decreased. REV’IT! will provide the customer with a quotation in advance as much as possible.

    • REV’IT! shall have the right to retain the Airbag Avertum Tech-Air® until the customer has fulfilled all his (payment) obligations in respect of the Airbag Avertum Tech-Air® provided to REV’IT! for Service, on the basis of any written or verbal agreement between REV’IT! and the customer. In the event of non-payment after thirty (30) days from receipt of the payment request, REV’IT! shall have the right to sell, destroy or otherwise dispose of the Airbag Avertum Tech-Air® directly or indirectly and at its sole discretion.

 

  1. Warranty
    • Service of the Airbag Avertum Tech-Air®, does not extend the two-year warranty of the Airbag Avertum Tech-Air®. REV’IT! warrants that the Serviced parts of the Airbag Avertum Tech-Air®, with the exception of any software and subject to normal handling, usage and storage, will comply with the specifications for one (1) year after Service has been performed, for a maximum of four (4) years after the Airbag Avertum Tech-Air® was first sold to the customer or after the Airbag Avertum Tech-Air® has been Serviced four (4) times, whichever occurs first.
    • This warranty shall not apply if the non-conformity of the Airbag Avertum Tech-Air® results from:
      • unauthorized modifications to the finished Airbag Avertum Tech-Air® and/or mishandling thereof; and/or,
      • the customer’s handling, using or storing the Airbag Avertum Tech-Air® in violation of any instructions of REV’IT! in relation thereto; and/or
      • damage arising from the following actions by the consumer are also excluded: improper use, normal wear and tear, deployment, tampering, incorrect Airbag Avertum Tech-Air® maintenance, damage caused by falls and/or accidents and/or repairs or services carried out by parties other than REV’IT!.
  1. Limitations
    • REV’IT! shall not Service any Airbag Avertum Tech-Air® that has been tampered with by anyone other than a REV’IT! service centre.
    • Airbag Avertum Tech-Air® Services always reflects the situation at the moment the airbag was brought in and are limited to the Services offered by REV’IT!. The Services do not guarantee the absence of defects that cannot be detected or are not part of the Service. REV’IT! shall not be liable for defects that are not visible or that are not part of the provided Services.
    • REV’IT! has the right to unilaterally change, suspend or terminate the Service.

  2. Privacy
    • While obtaining the Service, REV’IT! asks the customer to provide it with certain personally identifiable information that can be used to contact or identify the customer. Personally identifiable information may include, but is not limited to email address, first name and last name, phone number, address, state, province, ZIP/postal code, city and usage data which may be collected automatically when using or requesting the Service. Usage data may include information such as the customer’s device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of REV’IT!’s website that are visited, the time and date of the customer’s visit, the time spent on those pages, unique device identifiers and other diagnostic data. Additionally, REV’IT! may obtain certain personally identifiable information from the Tech-Air app, such as details from the customer’s rides, which may include, speed, duration, distance and location.
    • When the customer accesses the service page on REV’IT!’s website or application by or through a mobile device, REV’IT! may collect certain information automatically, including, but not limited to, the type of mobile device the customer uses, the mobile device unique ID, the IP address of the mobile device, mobile operating system, the type of mobile Internet browser used, unique device identifiers and other diagnostic data.
    • REV’IT! may also collect information that the customer’s browser sends whenever the customer visits our service page.

  3. Miscellaneous
    • By requesting the Service, the customer agrees with the Service Terms and Conditions, the Privacy Policy and the terms and conditions regarding the purchase and sale of products.
    • The Service Terms and Conditions will be governed and construed in accordance with the laws of the Netherlands. All disputes arising out of or in connection with this Agreement shall be exclusively resolved by the competent court in ‘s Hertogenbosch, the Netherlands.
